Acknowledgement of Risk and Waiver of Liability

 

I recognize that certain classes will involve physical activity, represent that my child is in good health and has no disability nor physical impairment that would preclude him/her from participating in the physical activity required for the classes.  I also recognize that classes involving physical activity may result in injury as a result of that activity.  Knowing the above, for myself and the minor, I do hereby release, discharge, acquit and forever forgive Umbrella Arts, LLC, its employees, instructors, agents and officers from any and all present and future causes of action, civil or criminal claims, demands, damages, costs, attorneys fees, loss of services, expenses, compensation, third party actions, suits at law or inequity, including claims and suits for contribution and/or indemnity of whatever nature, and all consequential damages, and all known and unknown personal injuries, death, and/or property damage arising out of participation or taking classes or instructions at Umbrella Arts, LLC. 

I also understand that if the student and/or parent becomes disruptive, argumentative, or defamatory toward Umbrella Arts, LLC, in person or otherwise, the student is subject to immediate dismissal from the studio, at the discretion of the directors.  The above applies to all family members of students while on the premises of Umbrella Arts, LLC.  

I further understand there is potential risk of contracting a communicable disease, including but not limited to COVID-19, while participating in Umbrella Arts, LLC’s activities, and I agree to waive any and all claims of liability, release and hold harmless Umbrella Arts, LLC, in the event that such injury or contracting a communicable disease may occur to me or my child.

 

Authorization to Seek Medical Attention

 

In the event of accident or injury, when parent, legal guardian or emergency contact are not available, I give my permission to Umbrella Arts, LLC, to procure medical attention.

 

Parent and/or Guardian Release of Claims

 

I am enrolling my child at Umbrella Arts, LLC.  I understand that tuition is based on a seasonal fee as a flat rate, with the option to pay full tuition in one payment or opt into a payment plan.  I am agreeing to be responsible for tuition payments until notification of withdrawal.  I understand that I must notify the office by written notice prior to the month of withdrawal.  If payments are made in installments, I know they are due the 1st of each month. I am aware that there are NO REFUNDS or DEDUCTIONS for the classes not attended given the option to make up those classes at the discretion of the directors. 

 

Photo/Video Release Form

 

I grant permission to Umbrella Arts, LLC, and its agents and employees the irrevocable and unrestricted right to reproduce the photographs and/or video images taken of my children for the purpose of publication, promotion, illustration, or advertising, in any manner or in any medium. I hereby release Umbrella Arts, LLC, and its legal representatives for all claims and liability relating to said images or video.

 

 

I further state that I have carefully read the foregoing Release and know the contents thereof and by participating in any class or event, I agree to all terms as outlined above.
